1. Introduction
Welcome to HousePlan ("HousePlan", "we", "us", or "our"), an AI-powered platform that helps users generate, modify, and visualize residential floor plans, house layouts, architectural concepts, and related design materials.
By accessing or using HousePlan, you agree to be bound by these Service Terms ("Terms"). If you do not agree to these Terms, you may not access or use the Services.
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services.

HousePlan provides AI-powered tools that may generate:

Design recommendations
Construction-related planning assistance
The Services are intended for informational, conceptual, and creative purposes only.
HousePlan does not provide licensed architectural, engineering, surveying, construction, legal, or regulatory compliance services.
3. User Accounts
To access certain features, you may be required to create an account.
You agree to:

Maintain the security of your account credentials.
Notify us immediately of unauthorized account use.
Accept responsibility for all activities occurring under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. User Inputs and Generated Content
User Inputs
You may upload:

Floor plans
Design references
Property information
You retain ownership of your Inputs.
You represent and warrant that you possess all rights necessary to upload and use such Inputs.
AI Generated Outputs
The Services may generate:
Floor plans
Design concepts
Layout recommendations
Images
Documents
Visualizations
Because Outputs are generated by artificial intelligence:
Outputs may not be unique.
Similar Outputs may be generated for other users.
Outputs may contain inaccuracies or omissions.
Outputs should be independently reviewed before use.
You are solely responsible for evaluating the suitability of any Output.
5. Architectural and Construction Disclaimer
HousePlan is not a licensed architect, engineer, contractor, or building consultant.
All generated Outputs are provided solely for conceptual and preliminary planning purposes.
You must not rely on AI-generated Outputs as:
Construction documents
Permit application documents
Structural calculations
Engineering plans
Electrical plans
Plumbing plans
Fire safety plans
Regulatory compliance documentation
Before construction, renovation, permitting, or property development activities, you must consult qualified professionals and verify compliance with all applicable laws, regulations, zoning requirements, building codes, and safety standards.
HousePlan is not responsible for construction errors, design defects, regulatory violations, permit denials, project delays, property damage, or personal injury resulting from reliance on Outputs.
6. Intellectual Property
Platform Ownership
The Services, software, models, algorithms, branding, and related intellectual property are owned by HousePlan and its licensors.
User Ownership
Subject to your compliance with these Terms:
You retain ownership of your Inputs.
You own the Outputs generated through the Services.
To the extent permitted by applicable law, HousePlan assigns to you any rights it may have in such Outputs.
Because artificial intelligence may generate similar or identical outputs for different users, HousePlan does not guarantee that any Output will be unique or exclusively available to you.
HousePlan retains ownership of the Services, including its software, models, algorithms, interfaces, trademarks, and other intellectual property rights.
License to HousePlan
You grant HousePlan a limited, worldwide, royalty-free license to process your Inputs solely for:
Providing the Services
Improving service performance
Security monitoring
Abuse prevention
Legal compliance
If HousePlan offers an opt-out option for model training, your data will be handled according to the applicable Privacy Policy.
7. Acceptable Use Policy
You may not use the Services to:
Violate any law or regulation.
Infringe intellectual property rights.
Generate fraudulent documents.
Impersonate licensed architects or engineers.
Create misleading permit or construction documents.
Upload malicious code.
Interfere with platform operations.
Reverse engineer the Services.
Access the Services through unauthorized automated methods.
8. Subscription and Payments
Certain features require a paid subscription.
Subscription plans, pricing, quotas, and usage limits are displayed on the pricing page and may be updated periodically.
Subscriptions automatically renew unless cancelled before the renewal date.
You authorize HousePlan and its payment processors to charge applicable fees.
Failure to pay may result in suspension or termination of Services.
9. Credits and Usage Limits
HousePlan may operate using credits, generation quotas, or usage-based limits.
Credits:
Are non-transferable.
Have no cash value.
May expire if specified at purchase.
May be revoked if obtained through fraud or abuse.
Unused credits are generally non-refundable unless required by law.
10. Refund Policy
Unless otherwise required by applicable law:
Monthly subscriptions are generally non-refundable after service delivery begins.
Annual subscriptions may be eligible for partial refunds within 14 days after purchase.
Refund requests are evaluated on a case-by-case basis.
HousePlan reserves the right to deny refund requests involving abuse, excessive usage, or violation of these Terms.
11. Availability of Services
We strive to maintain uninterrupted access to the Services but do not guarantee continuous availability.
We may:

Suspend functionality
Perform maintenance
Introduce new limitations
without prior notice.
12. Third-Party Services
The Services may integrate with third-party providers including:

Payment processors

We are not responsible for third-party products or services.
Your use of third-party services may be subject to separate terms.
13. Disclaimer of Warranties

WE DO NOT WARRANT THAT OUTPUTS WILL BE ERROR-FREE, BUILDABLE, CODE-COMPLIANT, OR SUITABLE FOR CONSTRUCTION PURPOSES.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSEPLAN SHALL NOT BE LIABLE FOR:
LOST PROFITS
LOST REVENUE
BUSINESS INTERRUPTION
PROPERTY DAMAGE
CONSTRUCTION COSTS
PROJECT DELAYS
REGULATORY PENALTIES
INDIRECT OR CONSEQUENTIAL DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO HOUSEPLAN DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
15. Indemnification
You agree to defend, indemnify, and hold harmless HousePlan, its affiliates, employees, and licensors from claims arising out of:
Your use of the Services
Your Inputs
Your violation of these Terms
Your construction or commercial use of Outputs
Your violation of applicable laws or regulations
16. Termination
We may suspend or terminate your access at any time if:
You violate these Terms;
Your use creates legal or security risks;
Required by law.
Upon termination, rights granted to you under these Terms immediately cease.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HousePlan operates, without regard to conflict of law principles.
18. Changes to These Terms
We may update these Terms from time to time.
Continued use of the Services after updates become effective constitutes acceptance of the revised Terms.
19. Severability
If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions, which shall remain in full force and effect.
20. Copyright Policy & DMCA Notice
We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the HousePlan Services that are reported to our Designated Copyright Agent.
If you are a copyright owner or authorized to act on behalf of one, please report alleged copyright infringements by sending a notice to our Designated Agent containing the following information:
A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest;
Identification of the copyrighted work claimed to have been infringed;
Identification of the material that is claimed to be infringing and where it is located on the Services;
Your address, telephone number, and email address;
A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
